1.- Contest Objectives
Through the present contest (the “Contest”), IBIZA DANCE CLUB.com, a registered trademark of BLANCO
Y NEGRO MUSIC S.A., will make available to all participants, in the terms stated below, a recording of the
original musical piece “SHARK” (the “Track”) interpreted by “MAURO PICOTTO”, whose exclusive exploitation
rights are owned by MEDIA RECORDS LTD., to the extent that the participants may create, with the
production means they dispose, a remix of the Track that can result in the prize described in Point 5 of this
document.
The present Contest will be held by IBIZA DANCE CLUB.com from their website www.ibizadanceclub.com
(the “Web Site”), where interested people will be able to register and participate in the contest.
2.- Available territories for the Contest
The contest will take place in the territory of the World.
3.- Opening and closing dates for the contest
The Contest will take place from 00:00 hrs, 11th August 2008 until 23:59 hrs, 11th September 2008, deadline by which
IBIZA DANCE CLUB.com will accept entries of the recordings of the remix.
The recordings should be sent by email and in MP3 format to: remixcontest@ibizadanceclub.com
IBIZA DANCE CLUB.com will not be held responsible for late entries that by any unforeseen cause may
affect the delivery to the mentioned email address.
The exclusive rights owner of all the delivered recordings will be MEDIA RECORDS LTD, record company
that will have all the exploitation rights over these recordings, specifically the rights to reproduce, distribute,
publicly communicate and make these recordings available, worldwide, in all formats (physical or digital),
and for the maximum time period stated in the Intellectual Property Law.
4.- Way to acquire the right to participate in the Contest
The right to participate will be granted through the reading and acceptance of the present conditions. The
winner must meet the obligations detailed in point 10 of the present document.
5.- How winners, prize, and prize value will be determined
5.1 – How winners will be determined
The determination of the winner will be held through a voting process by the members of a jury whose
designation corresponds exclusively to IBIZA DANCE CLUB.com. However Media Records Ltd and Mauro Picotto will be involved in the picking of the winner so they will be also members of the jury.
Having finished the voting process, the
results will be made public through the Web Site in the maximum time frame of 30 natural days to be
counted from the Contest's closing date, established in Point 3.
If the winner cannot be contacted through email within forty eight (48) hours from the end of the voting
process, or if the winner doesn't want to accept the prize, such prize will be awarded to the second place.
This same process will be repeated successively until the number of replacements determined by IBIZA
DANCE CLUB.com is finished. If all replacements are finished, the Contest will be declared null and not
valid.
5.2 – Prize
The prize for the winner will consist of a royalty of 2% for each record sold and paid, calculated from the
retail price and on a pro-rata basis, in any commercialized formats. For this purpose, the winner will sign a contract directly with the owner of the Recording. The final remix will not be used in any commercial format until the winner has not signed a contract with Media Records Ltd.
6.- Authorization for name and image use of the contest winner
In accordance to the condition of being the contest winner, the contestant authorizes BLANCO Y NEGRO MUSIC S.A., MEDIA RECORDS LTD, and IBIZA DANCE CLUB.com, respectively, to the usage of the image and name of the contest winner, in the Album, Web Site, and in any publication or other media, for promotional or commercial purposes, always provided that the usage has a relation to the Contest.
7.- Authorization for the use of the remix Recording
In the event that BLANCO Y NEGRO MUSIC, S.A. will have the rights for Spain of the master recording object of this contract, then BLANCO Y NEGRO MUSIC, S.A. will have the right to use the final remix version without any further payment to master owner.
8.- Modification
IBIZA DANCE CLUB.com reserves the right to modify the conditions in which the prizes will become
effective, without assuming any responsibility for this variation, in case this should be necessary by causes
that are out of hand or uncontrollable circumstances for IBIZA DANCE CLUB.com.
9.- Personal details
Having no prejudice to the terms in which IBIZA DANCE CLUB.com collects the necessary data for their
newsletter subscription (terms that will be informed to the contestant), the contestant is by this clause
informed that personal details (full name, postal address, email, or telephone contact) which the contestant
is providing voluntarily for the participation in the Contest, may be incorporated to a database that IBIZA
DANCE CLUB.com is responsible for and the final destinatary, for the treatment to the effect that IBIZA
DANCE CLUB.com may manage the Contest and in particular, to be able to get in contact with the
contestant if the contestant results being the winner.
To exercise the rights of access, rectification, cancellation, and opposition, as well as to revoke the given
consent, the contestant must direct his or her solicitation to IBIZA DANCE CLUB.com with address Calle
Llacuna 11, 08005, Barcelona, or to the email address: privacy@ibizadanceclub.com.
10.- Terms and Conditions deposit
The contest terms and conditions document will be deposited in the offices of IBIZA DANCE CLUB.com,
whose address is the same as stated in the prior paragraph.
11.- Contract acceptance by the winner
The winner has a 10 (ten) day time limit to send two copies of the terms and conditions for the present
“Contest”, signed on every page, to the below address:
